Bail is an aspect of our legal system via which a person who has been accused, can be released from custody, temporarily. This gives that person the opportunity to continue with their lives and prepare to appear in court. If the person is involved in a criminal case, bail might be in the form of money, real property or even a bail bond. Either of these will have to be posted by the defendant or on behalf of that person. In effect, it is a guarantee of the person’s appearance in court. The accused is guaranteed reasonable bail by the Eighth Amendment of the Constitution of the United States.
